These Terms & Conditions (“Terms”) govern your access to and use of the SweetSurvey platform, including our website and mobile applications (collectively, the “Service”), operated by Triwings Infotech Private Limited (“Triwings”, “we”, “us”, or “our”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility and accounts
You must be at least 16 years old and able to form a binding contract to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us promptly of any unauthorized use.
2. Use of the Service
You agree to use the Service only for lawful purposes. You may not:
- Use the Service to send spam, unlawful, deceptive, harassing, or infringing content.
- Collect sensitive personal data through surveys without a lawful basis and appropriate consent.
- Attempt to gain unauthorized access to the Service, other accounts, or our systems.
- Interfere with, disrupt, or circumvent the security or integrity of the Service.
- Reverse engineer, resell, or exploit any part of the Service except as expressly permitted.
3. Your content
You retain ownership of the surveys, questions, and response data you create or collect (“Your Content”). You grant Triwings a limited license to host, process, and display Your Content solely to operate and provide the Service. You are responsible for Your Content and for ensuring you have the rights and consents needed to collect and process it, including from survey respondents.
4. Subscriptions, plans, and billing
- Certain features require a paid subscription plan with defined entitlements and limits (such as survey, response, and team-member limits).
- Payments are processed by our payment partner, Razorpay. By subscribing, you authorize the applicable charges.
- Plans renew according to the billing cycle you select unless cancelled. Downgrades and cancellations take effect according to the plan terms and may adjust entitlements.
- Except where required by law, fees are non-refundable. Applicable taxes may apply.
5. Service availability
We strive to keep the Service available and reliable but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue features from time to time, and perform maintenance that may temporarily limit access.
6. Intellectual property
The Service, including its software, design, and trademarks, is owned by Triwings or its licensors and is protected by applicable laws. These Terms do not grant you any rights in our intellectual property except the limited right to use the Service.
7. Termination
You may stop using the Service and close your account at any time. We may suspend or terminate your access if you violate these Terms or use the Service in a way that risks harm to us, other users, or third parties. Upon termination, your right to use the Service ends, and we may delete Your Content subject to our retention practices and legal obligations.
8. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including fitness for a particular purpose, merchantability, and non-infringement, to the maximum extent permitted by law.
9. Limitation of liability
To the maximum extent permitted by law, Triwings and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from or related to your use of the Service. Our aggregate liability for any claim will not exceed the amount you paid us for the Service in the twelve months preceding the claim.
10. Indemnification
You agree to indemnify and hold harmless Triwings from any claims, damages, and expenses arising out of Your Content or your violation of these Terms or applicable law.
11. Governing law
These Terms are governed by the laws of India, and the courts located in India will have exclusive jurisdiction over any disputes arising from or relating to these Terms or the Service, subject to applicable law.
12. Changes to these Terms
We may update these Terms from time to time. Material changes will be indicated by updating the effective date above and, where appropriate, by additional notice within the Service. Continued use after changes take effect constitutes acceptance.
